§ 1 Liability
No liability is accepted for correct function of the software and the correctness of information contained in the manual and other associated documentation. Neither UGSoft nor anyone else who has been involved in the creation, production or delivery of this product shall be liable for any direct, indirect, consequential or incidental damage (including damage due to loss of business profits, business interruption, loss of business information and the like) arising out of the use or inability to use the product.
§ 2 Rights to duplicate the software
(1) This software may only be duplicated if this is necessary for the use of the software. Necessary duplication include installation of the software from the original data media to the mass storage of the hardware used and loading the software into memory.
(2) In addition, the software may be duplicated for the purpose of backing up or archiving. However, only one backup copy may be made and stored. The backup copy must be clearly marked to be a backup of the licensed software.
(3) If it is essential to make regular backups of the entire data on the computer including the computer programs used, either for the purpose of data security or to ensure quick restoration of the computer system following total failure, you may only make the minimum number of copies of the software explicitly required for this purpose. The associated backup data media must be labelled accordingly. Backup copies may only be used for the purpose of archiving.
(4) Further copying of the software, which includes output of the program code to a printer, is not allowed.
§ 3 Multiple usage and usage in networks
(1) The server software may only be installed on the server hardware for which the server software is licensed. If the server hardware is exchanged, the server software must be deleted from the previously-used server hardware and a new server software license must be obtained for the new server hardware. If the server software is used simultaneously on an additional server hardware, a corresponding number of additional software licenses must be purchased.
(2) The client software can be installed and used on any client hardware connected via a network to the server hardware.
§ 4 Demonstration versions of the software
(1) §§ 2, 3 and 5 apply accordingly to demonstration versions of the software.
(2) Demonstration versions may only be used for a limited duration as specified with the demonstration version to check the software for functionality. The demonstration version must not be used for daily production work. Guarantees and liabilities of any type are excluded for demonstration versions. The user accepts all risks when using a demonstration version.
(3) If the specified time limit of an installed demonstration version has expired, you are not allowed to install a further demonstration version.
§ 5 Decompiling and program changes
(1) The decompiling of the program code to other forms of code and other types of reverse engineering of any of the manufacturing stages of the software, including the creation of derivative works based on the software or modification of the software, is not allowed.
(2) The removal of copy protection or other protection routines is not allowed.
(3) Copyright notices, serial numbers, and other measures used to identify the software must not be removed or modified.
§ 6 Prosecution
In case of violation of this license agreement, for example in connection with the copyright law, the right is reserved to start criminal and civil prosecution.
§ 7 Applicable laws
This agreement is solely governed by the laws of the Federal Republic of Germany.
§ 8 Place of jurisdiction
The place of jurisdiction for all disputes within the framework this license is Hannover, Germany.
